Since joining in WTO, overseas investment of China obtained the rapid development. However, because of the shortage of overseas investment insurance law, overseas investment of China faces great political risk. Accordingly, in order to protect the benefit of the investor and the interest of the country, establishing overseas investment insurance law system in China as soon as possible has been into consideration.The paper consists in four parts in total.The first part is the outline of the overseas investment insurance scheme ,firstly limit to implication of the overseas investment insurance scheme , then elaborate the legal characteristic of the overseas investment insurance scheme, which pointed out this kind of insurance system is a kind of country guaranteed or the government guaranteed, finally give the elaboration to the overseas investment insurance scheme on historical evolution.The second part throws analysis for the necessity of overseas investment insurance. In economical and lay aspects, the part carries on proof, which pointed out that the necessity of establishing the overseas investment insurance system in our country.The third part conducts the comparison research on the insurance institutions of U.S.A., Japan and Germany, which give the merits and flaws of each country. At the same time, the relative system of MIGA has been into brief introduction in the part.The fourth part first interprets the present condition of the Chinese overseas investment & protect, also carry on tentative plan for our overseas investment insurance institutions of China with profits from the legislations experiences of U.S.A., Japan and Germany.
