Research On The Legislation Of Overseas Investment Insurance Of China

Under the background of global economic integration, China’s overseas investment enterprise develops vigorously; however, the development of overseas investment insurance in our country is lagged behind, it is imperative to construct the insurance legal system. Overseas investment insurance is a legal system that originating countries protect the security of overseas investment for overseas investors to make up for the loss brought by political risk. In the1950s, overseas investment insurance legal system was born in the United States, then, Japan, Germany, Australia and other countries introduced successively.With the development of globalization, lack of overseas investment insurance system in our country, has severely hindered the pace of enterprise in our country. The purpose of this article is a comparative study on related legislation, to discuss the establishment of the overseas investment insurance legal system for China, to summarized and put forward suggestions to China’s overseas investment insurance legislation. The main content of this article includes four chapters:The first chapter:the overview of overseas investment insurance legislation. Firstly, the concepts of overseas investment insurance law, overseas investment, and political risk, are defined clearly. Secondly, the history of the development of the overseas investment insurance legal system is discussed, and the discussion lay a foundation for system analysis of the overseas investment insurance legislation.The second chapter:the overseas investment insurance legislation comparison research. This chapter does a system analysis on overseas investment insurance legislation of the United States, Japan and Germany about the system model, the insurer, insurant, insurance object and scope of insurant, hoping to provide some references for the perfection of China’s overseas investment insurance legislation.The third chapter:the present situation and problems of China’s overseas investment insurance legislation. This part mainly discusses the present situation of China’s overseas investment insurance legislation and the problems of it.The forth chapter:the perfection and suggestions of China’s overseas investment insurance legislation. In order to perfect our country’s overseas investment insurance legislation, this chapter puts forward some suggestion from the system model, the scope of the insurer and insured, the insurance object, scope of insurant, etc.
