Study On Euthanasia Legislation

Death, as an important legal case, is an unavoidable problem to every one alive and will lead to many of the relevant legal consequences. Death symbolizes the metabolism of the universal law, but the manner of death is different. Euthanasia is a controversial issue which has long been plagued with theoretical and judicial sectors. However, the legalization of euthanasia, as a choice of values trend, has been gradually accepted by the people all over the world.The origin of euthanasia comes from the Greek, which means not painful, but happy death. "Oxford Law Dictionary" interprets euthanasia as an incurable patients taken by the request of the cause or accelerate the death measures. "Black Law Dictionary" thinks that euthanasia starts from compassion and executes people suffering from an incurable diseases. However, as our scholars explain, euthanasia is a process that makes critically ill patients suffering from the incurable disease die without pain in the request of themselves and their relatives, after the implementation of approved doctors. Many countries are now in the study and exploration of euthanasia. The nations nowadays vary from the practice of euthanasia for whether the acts constitute a crime or not.The nature of euthanasia is not to make people to death, but grants people to happiness. Instead of solving the problem of death,its purpose is to ensure the quality of death. Not from the dead to the conversion, but from the painful transformation to happiness. With the adoption of the scientific method to the death process, people are dying in the process to avoid the mental and physical torture. Modern civilized society should respect the right of life and personal freedom of choice and provide patients with hospice care.Based on the origin and nature of euthanasia, legislative purpose and legislative basis in China , the need for legislation and the possibility of euthanasia systems, euthanasia legislative, judicial, law-abiding integration, and several other aspects of analysis and evaluation, China should establish euthanasia through legal proceedings. Euthanasia is the legal basis for legislation on euthanasia and from the implementation point of criminal law it also does not have socially dangerous acts. The law should not evade euthanasia, which should have its own legal status. This paper attempts to explore this euthanasia death to the relevant legal issues in order to effectively combat crime, in order to maintain the socialist legal system.
