Explorer The Plea Baragaining System

The plea bargaining system was developed in the United States from 1930s to 1940s. In the 1970s, it was accepted by the Supreme Court of USA and became a formal justice system. Since then, the system has been absorbed and drawn by civil law countries, such as Spain, Germany, Italy, France and so on. And it has been an important impact on the criminal justice system in the world.This paper focuses on four aspects of the plea bargaining system.Chapterâ… , with the introduction on the formation of plea bargaining system, the establishment and development, concepts and theoretical disputes and China's judicial practice ,we are attempt to outline a complete picture of the plea bargaining system. On this basis, it is conclusion that the plea bargaining system which is able to be widely accepted and follows the tradition of Chinese law should be constructed in China by the author's thinking about the meaning of the plea bargaining system.Chapterâ…¡, with the rational analysis on the value of the plea bargaining system, the author try to suggest that it is reasonable for the plea bargaining system. By studying on the problems associated with the plea bargaining system, it is further discussed that the plea bargaining system has made the conception of traditional justice remodel.Chapterâ…¢, with the analysis of China's introduction of plea bargaining system, it is discussed on the necessity and feasibility of the plea bargaining in China.Chapterâ…£, in author's opinion, the plea bargaining system should be introduced in China and the paper shows the suggestions on the principle, the application, the legitimate program, the mechanism of supervision of plea bargaining system and legislative proposals.
