On The System Of Socialization For The Relief Of Environmental Torts

People's capacity on transformation of nature increases with the rapid development of industry .One hand, people transforms the environment; on the other hand, the environment which has been destroyed brings damage to rights and interests of human beings. Environmental problem has become one of the serious social problems that human beings are confronting with at present. Environmental tort refers to damage brought by destruction and pollution of nature to human beings. Environmental tort has its own personality comparing with general tort. For example, it is unequal between the subjects of environmental tort, and the act of environmental tort is special. The consequence's characteristic contains gradualness and serious result. The traditional rescue method in civil tort has many limits on environmental tort, and victims can not be defended adequately. The system of socialization for the relief of environmental torts can relieve victims timely and properly, at the same time, not to influence survival and development of enterprises. The system of socialization for the relief of environmental torts can disperse risks effectively, and it has achieved significant improvement abroad. Some country have established the system of socialization for the relief of environmental torts, including environment liability insurance, fund of environmental damages, financial security and social security system. To some extent, victims have been relieved. It is necessary to draw on the experience of other countries combining with our country's practice and to establish our country's system of socialization for the relief of environmental torts. In our country, the environment liability insurance should be the major measures, with the support of social security system so as to achieve the system of socialization for the relief of environmental torts. This article gives some advices to establish environment liability insurance and social security system.
