Research On The Socialization Of Damage Compensation In Environmental Torts

Environmental tort has led to a series of social problems, which have become significant problems to be solved in the worldwide. However, when using relief measures to tackle these troubles, all nations are in the situation where the support is inadequate, inflicter’s legitimate interest is damaged and social economic development is hindered.To deal with these matters, developed countries such as the US, Japan, and Germany have been trying to find out solutions in 1960s and gathering practical experience. These countries have so far built a stable and feasible compensation system--damage compensation system for environmental tort. This system has become the basis in terms of environmental problems, as it addressed environmental torts properly.To address the problem, the essay will discuss the theory about damage compensation system, analyzing the possibility and rationality of the system. The essay will focus on the development of two systems, namely environmental liability insurance system and environmental compensation and public compensation fund system at home and abroad, and their advantages and disadvantages. I will give suggestions on how to build these two systems at the end of the essay.
