After computer network came into being in 1960s, it developed as an index type which formed an irresistible tendency and it turned the whole earth into a net and data village. A new technology revolution is coming into being in nowadays society--a digital revolution. The feature of the revolution is digital which brings a Neway for human beings. After 1990s, Internet yielded unusually brilliant results and now it has already covered nearly every country and all the districts at the speed of developing millions of families monthly. It seems that it comes just in one night. The Internet seems has the vigour of covering the whole world. The existence of the Internet changed not only the work style and living style of human beings, but also influenced the world politics, economics and military matters.The gift of every technology or science has its shady side. When people cheered for the new life that network brought, it never meant the network could only be used in bringing benefit to human beings. When we cheer for the wonders the network made, we shouldn't forget a reality: network made new problems and troubles while it brought civilization. Recently the Internet has developed much in the world. It also brought us new problems. We're happy that technology brought us convenience, but we are also worried about the problem that it may be difficult for us to control the virtual social groups. High technology contains high economic benefit and social benefit, which has high strategic value for society, but it can also be used to destroy society, civilization and the tendency. Materialist dialectics tells us that anything has both advantages and disadvantages. Many problems also exist in the Internet: against science, fake science, unhealthy and harmful information are flooding in the Internet; someone even releases fake information to mislead people; personal privacy, industrial secrets hard to be kept, communication break done by attack from hackers which cause paralysis of network. The development of information technology and computer network promotes the development of economy and the society. While it brings people convenience in life, it also brings a revolution of crime way. Network is not the Eutopia people expected, but a dangerous heaven of crime.In 1940s, famous American criminologist Edwin·H·Sutherland started to analyze and study the possibility of crime that carried out by wisdom and modern technological tools. He advised the criminologists to focus their attention on the crime carried out by wisdom and modern technological tools rather than traditional crime. The opinion was accused at that time, but nowadays technological revolution brought into the information network era. The situation changed our social economic structure that existed for a long time; what's more, the situation changed our sense of worth and social living type. We formed a new social space--network environment. There is no doubt that computer crime will become more complicated and its number will also become bigger with the general use of network. Because Internet is a fake space, it is global, transnational, creational, digital, intelligent and general; it has penetrability, real time, interactive nature and so on. At the same time, the Internet offers a new market for crime and becomes a new field of offender. Offenders created their new crime terrace. The scope and depth of its influence is the new experience that never exists in the human history. The danger it may cause is beyond the danger that any traditional crime may form. Everything is showing that network crime has already formed real threat for our society. As the fast development of network and the increasingly strengthening, as the number of users increase, network crime showed a fast growing tendency. Network crime is becoming more and fiercer, and it has already threatened the existence and development of the Internet, to be the most serious hidden trouble in the information era. As the popularity and expansion of network, more and more people master the technology of network. Corresponding other kinds of network crime will increase; the activity of network crime will become more and more novel and covert. In the future many other new forms of crime will appear which will influence the normal order of our country's politics, economy, and civilization and so on. To realize these, we should develop advantages and get rid of disadvantages to establish an indemnity system of computer network, protect our country's economy and social security so as to promote the healthy development of computer network. To strengthen the security of network, we should take measures to defeat network crime to keep network and information safe and promote the healthy development of information. This has already become an urgent problem for to solve for legislature, judicial authority and administration service, what's more, this has also become an attractive problem in computer technological field and law field.This thesis is divided into three parts. The first part is computer network crime and the analysis of crime. By the chief introduction of origin and development of the Internet, we introduce the era background of network crime; combining with computer crime we discussed the concept and features of network crime, and analyze the structure of computer network crime; the thesis analyzes the types of network crime. The thesis put forward the writer's opinions on the reasons of computer network crime. The second part is legislation comparison of network crime. In this part the thesis formulize area name and the setting of crime name of network crime as well as the analysis of our country's network legislation and relative crime names; what's more the thesis also illustrates the defectiveness of computer network legislation of our country. The third part examines the social background of network crime's treatment. The thesis advocates to build a network crime system of one including multi-dimension.Above all, as the projection and mapping of real world in the subjunctive space, computer network has already become the second society beyond real society. The social problem caused by the reason and network crime continues to appear. Because the form of network crime is more covert than traditional crime with higher means and more difficult to control than common crime, it has already threaten the security of the Internet and the development of social economy. On the base of analysis of computer network crime and the crime, by the legislation comparison of network crime, we should look for the efficient way of solving network crime to defeat network crime so as to control network crime.
