Along with the progress of human society and the development of computer network technology, the relationship of the human life and the network becomes so closely. The computer makes the human life more convenient, while a new form of crime was born by it. Since the new century, the various of cybercrime growed quickly. Network intrusion,network virus,internet gambling, internet porn filled in every corner of the computer network. How to use the laws punish the cybercrime has become an important topic.Cybercrime becomes a new issue human beeing should face in the development of information technology. The openness of cyber and the intelligence of cybercrime propel the academicians to distinguish cybercrime from the traditional crimes, causing the traditional theories of crimes to face new problems and confusions. It's an urgent task to define cyber and cybercrime and to build up the theoretical system of punishing cybercrime. The academic society has made remarkable achievements in the study of cybercrime theories and the judicial practices of different countries have provided us successful experiences for reference. The study of cybercrime theories will surely lay a solid foundation for the nerfection of legislation on cybercrime in China.In recent years, the net crime mainly presents in the following features:lower-age and diversity of criminals, the uncontrollable boundless space for taking place crime and its severe consequence.Not only does the crime invade the legal rights of the people, badly influnce the social public order, but also harm the safety of the country. Therefore, it is supposed to do the research for preventing and controlling net crime from 3 parts: organiztion, system and culture. By doing these, the crime will be effectively prevented and the legal rights of the nation and group as well as the individuals will be protected. The author is engaged in the work of computer network. In their daily work,we often find some action of cybercrime, but because of the criminal justice system of the cybercrime is not perfect, many criminal acts can not be effectively punished, the vacuum of the cybercrime makes the criminal unscrupulous.How to reflect the purposes of the criminal law becomes an issue that the criminal workers must think aboutIn the opening of this paper, the author will studies of the cybercrime as a separate form of crime. Find the characteristics of cybercrime. Then i will analyze the constitution of cybercrime. The constitution of cybercrime contains the object of crime,the objective aspect of crime,the subject of crime,the subjective aspects of crime. Later the author will introduces the chinese and the other countries′criminal of cybercrime . The part three of the article, the author will analyzes the typical example of the cybercrime, then he proposes the issure of cybercrime in the action of criminal justice.the author wants to find the bug of the chinese criminal, and put forward his suggestion about the comprehensive of the cybercrime .the author wants to perfect the criminal of cybercrime and prevents the cybercrime.
