Since international law came into being, the issue of humanitarian intervention has been one of the most controversial problems of international law and politics. The thesis is divided into 5 chapters. In chapter 1 the conceptual clarity of humanitarian intervention has been defined. In chapter 2 the author has overviewed the humanitarian intervention events as well as analyzed them. Chapter 3 stated the relationship between humanitarian intervention and the fundamental principles of international law. The thesis has argued that humanitarian intervention violates three major principles provided for in the UN Charter: "the state sovereignty", "prohibition from the use or the threat of use of force" and "non-intervention". Chapter 4 presents the existed problems attached to humanitarian intervention from the perspective of reality.At last, in chapter 5, the author has concluded that how to define and constrict humanitarian intention, harbored the principles China should adopted and insisted face to humanitarian intervention.
