The Limited Autonomy Of The Public Higher Educational Institutions

The public higher educational institutions are the place for all humanity to create knowledge, to disseminate knowledge, to promote national progress and promote human civilization and social development .The autonomy of the colleges and the universities has always been the focus of controversy by the academic community.This paper aims to establish the nature of the public higher educational institutions , by analysising the different view both at home and abroad as to the nature of public higher eudcational institution, from the perspective of social law ,then made the public higher educational institutions reasonable position, and combined with the emerging issues of the autonomy of the public higher educational institutions, carried out the view of the autonomy should limited,and bulit the system of the autonomy of the public educational insistutions. In this thesis, for the view of the autonomy of the public higher educational institutions are limited, to focus on the "public interest", then build the better system.The main contents of this paper is divided into five chapters.The first chapter is the basic concepts of the definition,to clear the public higher educational institutions,autonomy, and the autonomy of the public higher educational institutions.ChapterII discussed the nature of public higher educational institions, and described from their extra-territorial views and perspective views ,then proposed the public higher educational institions should been considered the subject of social law, so that the position is not only the need for the structural reform of China's higher education , but also the inevitable result of social development. Chapter III is the autonomy and autonomy rights of the public higher educational institions. And to clarify the nature of autonomy, to analysis the autonomy's content, besides analysis the matter of the blindness, convergence and utility which have taken place in the autonomy of the public higher educational institutions.Chapter IV is the theoretical basis of the autonomy for the public higher educaitional institions should limited, to analysis the group benefits of the autonomy ,the value of higher education and the pursuit of real justice,then put forward the theory of the auronomy of the publia higher educational institionsis are limited.Chapter V is to build the external and internal system of the restricted autonomy of the public higher educational institions.
