Study On Law Application Of Liability Of Foreign Product In China

With the development of international economy and the extensive circulation of the product among the country, the cases of the liability of foreign product increase day by day . The application of the liability of foreign product relates the party's benefit very much , so this leads to the research of liability of foreign product and the country gives more attention to it .Nations especially western country successively regulates the law and international treaty of liability of foreign product ,but our country has not set up the special legal system of application of law of liability of foreign product at present. Chinese most substantive law hardly regulates foreign infringement; in the areas of law of conflict ,only《Civil law》can be used for the basic principles .Adopting the local application of law to tort which makes the application of law of the case of complex liability of foreign product excessively simple. Moreover this can not meet the demands of judicial practice and protect Chinese consumers. Finally such affects development of foreign trade of china .So this thesis makes some suggestion on the perfection application of law of Chinese liability of foreign product with a historical analysis methods, a comparative analysis methods and a case analysis methods.
