Research On Law Application Of Liability Of Foreign Product In China

In the globalization process, our products have found their ways to every corner of the world, and simultaneously, there is also a large influx of foreign products into our country. Our country has encountered unprecedented opportunities and challenges in areas pertaining to foreign products liability legislations and judicial practices. This article will lead to a scrutiny of the applicability of our legislations concerning foreign products by a starting point of the recall of Toyota automobiles in our country. An analysis of the applicability of the legislations regarding foreign products liabilities will then be undertaken, with an attempt to pinpoint some of the problems in the present legal system that deals with foreign products liabilities. Based on an international comparison of the legal applicability of their legislations in pertinence to foreign products liabilities between the United States and European Union, combined with the problems in the present legal system that deals with foreign products liabilities and the development of the foreign products liabilities legislations of other countries. Suggestions on the applicability of an evaluation of article 44-45 of Law of the Application of Law for Foreign-related Civil Relations of the People's Republic of China will be made to improve the applicability of our foreign products liabilities legislations. And measures on the Application of Law of the PRC Foreign Civil Relations Law will be recommended to resolve the problems that are probably present...
