Research On Similar Necessary Joint Action

Joint action,which is the product of interaction between civil subjects as the frequency of communication between civil subjects speeds up with the development of economy,is a most important system in civil procedure.But in the early days of legislation of China's civil procedure law,due to lack of in-depth study,joint action is only distributed into two classes:common joint action and necessary joint action,fine differentiation of necessary joint action is not made.The problem of the system becomes more and more prominent with the continuous development of judicial practice.To meet with the requirement of diversification of necessary joint action in judicial practice in an attempt to one-timely settle disputes as far as possible,it is necessary to make fine differentiation of necessary joint action and introduce similar necessary joint action into judicial practice, which is of great significance to protect the rights of the party and achieve the unification determination.In this paper,similar necessary joint action is discussed from different aspects,such as the concept,essentials of establishment,the effectiveness of the party's behavior and the application scope.
