The Improvements And Deficiencies Of The Security Interest System In The "Property Law"

The Security Interest System is an important part in the "Property Law". The contents about the Security Interest System have been changed a lot in the "Property Law" which has been implemented in 2007, and many papers on these changes have been written by scholars. By comparing the Security Interest System in the various historical periods prior to "Property Law" from the point of view of historical development ,this article is trying to analyze the improvements and deficiencies of the Security Interest System in the "Property Law". In this paper, the Security Interest System in an overview is introduced from the start. The Security Interest System in the period before Chinese Liberation is elaborated in the second part. The Security Interest System in the "General Civil Law" and its Judicial Interpretation is analyzed in the third part. The Security Interest System in the "Security Law" and its Judicial Interpretation is discussed in the fourth part. The improvements of the Security Interest System in the "Property Law" are got in the fifth part by making a comparison between the "Property Law" and the above-mentioned parts. The deficiencies and suggestions of the Security Interest System in the "Property Law" are proposed in the last part.
