The soul of the Civil Code is equality and autonomy,which is to build the foundation of the building throughout the Civil Code.The Civil Code in the design of each system are based on this,of course,the system of care is no exception.Because of concept,the tradition,the situation nowadays and the legislative techniques,the convention of guardianship is too principal and hard to be used in practice.It also has too much disadvantages and far to the real life.With the coming of the society of more old people, the concept of protection of human rights is popular now,so the reform of guardianship is on the way.We should know more about their life.This paper discusses the trend of the guardianship in our country comparing with the system overseas,which begins from the origins and characteristics.
