China's Confucian tradition of criminal law can be said that in the Xi Han Dynasty officially beginning the mid-longitudinal Wei, Jin and Southern and Northern Dynasties, the Sui and Tang Dynasties down gradually mature and stereotypes, and some important system for the generation of the Song, Yuan, Ming and Qing Dynasties followed, in ancient China through to the disintegration of society.The performance of China's Confucian tradition of criminal law is in various aspects. It is a dynamic process of development, the law of each historical period is not the Confucianization complete copy of the results before, has its own new content.The current Chinese society by the end of the tremendous impact of traditional culture, so the rule of law on the criminal law should also be the process of Confucian thought and a lot of good to be a useful system to its still reasonable succession of elements, to abandon its dross. While this drawing can not be referred to as the true sense of the Confucian law, in a sense and extent, it can be called the traditional Confucian society of the continuation of the criminal law. At present, the academic study of this issue for more, in view of this, this article focus on the law of the Confucian tradition of research, legislative and judicial performance, such as impact on the community aspects of a general sort, with a view on this issue in a more and more understanding, to re-explore some of our country learn from the modern meaning of the rule of law.
