Study On Several Legislation Problems Of The Prevention And Control Of The Alien Species Invasion

In recent years,with the acceleration of globalization and the rapid development of global trade,transportation and tourism,alien species invasion becomes the second important factor which leads to the biodiversity extinct,next to the destroy to the habitat.To avoid the invasion of alien species,many countries in the world have formulated laws and regulations,which could prevent,control and eliminate the invasion of alien species.China's research to this field is quite late;therefore,existing laws and regulations are very scattered,not targeted,and hard to meet the demand of the control of alien species invasion.Thus,by using several research methods,including theoretical analysis,positive analysis and comparative analysis, the author attempts to begin with the difficult situation in China while using the current laws and regulations to control the alien species invasion,and make an analysis to this legislation in China,then reflect on the deficiency;at the same time,the author will learn the experiences from the advanced countries such as America,Japan and New Zealand,and aim at the holes in legislation,to put forward the countermeasures for improving the legislation for alien species invasion in China.The author thinks,China should formulate a law specifically for the invasion of alien species under the guidelines of scientific concept of development,aiming to keep the ecological balance,to ensure the ecological security,and to promote sustained development of economy.Meanwhile,the existing related laws and regulations need to be modified systematically.China needs modify the content which is unfavorable to the control of alien species invasion;create the detailed regulations to strengthen the maneuverability,to implement the work of prevention and control in real earnest.Besides,the author will base on the periodical features of the alien species invasion,attempt to set up a whole process control system,to make sure that the invading alien species are under the control from the cradle to the grave.The author hopes that this article will stimulate more good ideas from others in order to protect China's ecological environment.
