On The Protection From Criminal Law On Male Sexual Right

The right on sex is one of the fundamental rights for every citizen in the society, which belongs to a part of the personal rights. The criminal law protection on sexual rights is developing towards to the direction of single polarization. It is obvious not to attach enough importance to the criminal law protection on sexual rights in China. Whereas abroad, both in the UK-US legal system countries and landmass legal system countries, who almost have relative legislative requirements in the area of male sexual rights criminal law protection.Owing to the requirement based on criminal law function and the concept of human rights, combined with the reality of judicial practice, it is quite necessary to strengthen and improve the criminal law protection on male's sexual rights in China. For this reason, this study proposes to amend the relative stipulates on the crime of rape, which may change the names from the crimes of coercive indecency and insulting offence against female to compulsory indecent crimes while amending the criminal law currently, may expand the targets of crimes on child molestation charges in order to adapt to the needs of the criminal law protection on sexual rights.
