The Construction Of Victim-offender-reconciliation System In China

With the democratization and scientific development of legal system, drawbacks of traditional criminal judicial system are increasingly prominent, such as the neglect of victim's interests. The recent appeared victim-offender-reconciliation system, which is based on the parties involved, is a new approach to solve disputes. Endeavors are extended to balance benefits of the two sides in litigation, to propel our country's criminal judicative reform, to renew the varied relationships, and to enhance the harmony of society. Through analysis on the concept and characteristics of victim-offender-reconciliation system, this thesis probes into the necessity and the feasibility of victim-offender-reconciliation system in China. Consequently, it intends to construct victim-offender-reconciliation system in China based on both legislation experience and practice from foreign countries and the legislative reality of our country.
