Study On The Scope Of Victim-offender-reconciliation

With the emergence and development of the idea of restorative justice in the west, the criminal reconciliation system has become one of the widely used criminal systems in the world. Although the criminal reconciliation system in our country has been introduced, but has not been accepted by the traditional theory. With the deepening of the civilization construction of the rule of law in our country and scholars on the theoretical research of the human rights of tireless research, the modern concept of the rule of law is enriched, as China began to pay attention to safeguard and respect for the human rights of the offender and the victim, the position of the criminal reconciliation system has become increasingly important, the value of criminal reconciliation system was given a new meaning. The scope of the criminal settlement of criminal cases or limit the scope of the direct decision to achieve the value of the criminal settlement system. Therefore, it is important to study the scope of criminal reconciliation cases.This paper is divided into four parts. The first part is to sort out the context of China’s crimin al reconciliation cases, the scope of criminal reconciliation cases cited in the scope of the pro blem and its analysis. The third part is to investigate and compare the scope o f foreign criminal reconciliation cases, summarize the similarities and differences of the deve lopment of criminal reconciliation in different countries. The fourth part first by adjust the cu rrent scope of criminal reconciliation cases, foreshadows the reform approach of criminal rec onciliation, and actively seek the theoretical support of localization, help to expand the scope of cases of criminal reconciliation, finally proposed a phased improve the scope of criminal reconciliation cases of three step concept.
