The Legislative Enlightenment To China On Protection System Of Environmental Right In The EU

Environmental right have become a new right concept since the environment crisis arisen.It was discussed and studied since early 1960's in the international community.It became the new content of human rights has been rapid development.Then many countries have regulated environmental right in their constitutions in order to protect it and the environmental sources.In our country,the study on theory of environmental right began in the 80's.Up to now,a large number of China's scholars have been fruitful in the theoretical research on environmental rights,which provide a theoretical basis for the legalization of environment right.However,the study on legislation of environment right in our country is not enough. The improvement of China's legal system on the protection of environmental right is conducive to solve environmental problems fundamentally.As a supra-national governmental organization,the EU's legislations on environment right have decades of history and have made some achievements.From European Convention on Human Rights to Aarhus Convention,the protection of environmental right is gradually improved in the EU.In the Aarhus Convention,the European Union considers environmental right as the three procedural rights to be protected:the right to environmental information to know,the right to environmental issues to participate in and the environmental relief right,which realizes the aim to protect environmental right and deserve to be learnt for China.
