In modern society, the administrative reward as a new type of effective management means and methods of modern government has been widely used in all areas of society. In the administration, it plays an important role. To explore and practice administrative reward have become the important subject to improve the system of government management. But there are a variety of shorts and defects in administrative reward at present in China, it needs for further refinement.So, the author do research on basic theory of administrative reward system at first ,introduce the history of administrative reward system from old times systematically analyzes defects of the administrative reward system .It also raises the constructive advice for administrative reward system to improve it. This paper is divided into five main parts:Part I : On an overview of the administrative reward system. In this chapter, based on the existing opinions on administrative reward, the author brings the reconstruction of administrative reward in its category, meanwhile gives the following characteristics, an administrative act, the non-mandatory administrative act and administrative benefits act. In addition, the author also analyzes the constitution of legal relations on administrative reward. In the perspective of administrative law, sociology, and psychology, the author discusses the inner theoretical basis.Part II :On the history of the administrative reward system. From the beginning of the Qin Dynasty, it introduces the phenomenon on ancient and modern administrative reward in China in the first part of this chapter. It introduces the practice on administrative reward in the world in the second part of this chapter. It analyzes the changes and current situations of administrative reward, and divides the four stages for the development of administrative reward system: 1) the term of creation and development of administrative reward system; 2) the term of serious damages; 3) the term of restoring and reforming; 4) the term of development and perfection in the third part of this chapter. Finally, the author focuses on the current situations on administrative reward system in China.Part III:On the defects of administrative reward system in China. First of all, it gives the simple assessment for the typical cases of China's administrative reward, which brings China's shortcomings in administrative reward system. Secondly, based on the current situations of China's administrative reward system, it gives the specific analysis of the shortcomings, namely: the lag of legal conciseness of administrative reward, the not perfect law on administrative reward, the not proper acts of enforcement law of administrative reward and the lack of relief for administrative reward.Part IV:On the perfection of the law on administrative reward. The author put forward the new opinions to perfect the legislation, enforcement law and the relief on administrative reward. The author boldly introduces the complaint visiting system and national compensation system into the belief mechanism in order to protect the interests of the other party.Finally, the author sums up the implementation of the principle of executive reward system, the origins of the writing of this article, hope this could lead to administrative law theory and practice community attaches great importance to better improve the system.
