Research On Legal Problems In Developing Intellectual Property Securitization

Intellectual property Securitization as a novel and effective means of financial support is actually a financing through specific transactions based on intellectual property rights.It broadens the space which the value of knowledge in transformation. Optimize the way in practice of intellectual property strategy,upgrading the fusion efficiency of knowledge capital and financial capital,play enormous role in the progress of society and Technology.At present,overseas scholars in this field has been carried out ground-breaking exploration,research mainly concentrated in the following areas:Qualitative research in Intellectual property asset securitization;from the financial point of view,the superiority of financing in intellectual property assets;Empirical Analysis in legal system of Intellectual property asset securitization and so on.And domestic scholars limited to do the analysis of the concept,the reasonableness,introduction of foreign cases of intellectual property securitization;it is an absence for the legal issues research of intellectual property securitization,especially the combination of Chinese reality.This thesis included 4 parts.Firstly,this paper distinguished and induced the conception,Features,Nature and the development status and trends of intellectual property securitization.Secondly,Through study on the legal relationship of intellectual property securitization,the thesis give a Detailed analysis of the subject, object,content of the legal relationship of intellectual property securitization as well as risk prevention mechanisms and legal risk.Thirdly,based on inductiveness of foreign literatures and typical cases,the thesis searched the reference from the developed countries in developing intellectual property securitization to our country, and emphasized to study the range of intellectual property which can be securitized, legal problem in effectiveness,value evaluation,register of intellectual property transfer.Finally,based on analysis of the necessity and feasibility of the development of securitization of intellectual property rights in China,the thesis advanced proposals which contain:the design of the institution Qualifications and the process of intellectual property securitization in our country,and established a government-dominant operation in intellectual property securitization.Intellectual property securitization involves multi-ply fields such as technology,finance,law etc.At present;there are few study of intellectual property securitization in theory fields,and no systemic study.It has played a huge role in promoting the development of cultural Industry and high-tech industry.Here it would be more practical through the thorough study of intellectual property Securitization,activates our country's intellectual property industry and financial industry.
