China is a shipping country and an oil-import country,since the reform and open-door policy,The marine environment is under serious and potential threat by oil pollution from ships with a continuous and fast growth of china economy and the rapid development of the petrochemical industry and that of correlatives,especially together with rapidly increase of the number of the marine transportations of crude oil.China does not establish a national compensation fund for oil damage.This dissertation compares the current three different compensation fund models and analyzes the legal characters of the oil pollution compensation fund,then gives some suggestions on establishment of national of oil pollution fund in china.In views of the present situation of China,the right time for China to accede to the FUND Convention is yet to come while the domestic compensation fund is more practicable.We will make preparations for the accession to the Convention by way of the experiences gained from the management and operation of our own fund.This dissertation especially studies certain difficulties of this topic,Which include the characteristic of clear-up charges,fishery mid-long term losses,damage to the ocean environment and the qualification of the plaintiff.This dissertation introduce their concepts,the disputes about them,and in comparison with other countries, concludes the rules and means that Chinese court should adopt and gives some suggestions and advices for reference to Chinese scholars,legislators and judges.
