Study On Our China’s Compensation Fund System Of Oil Pollution Damage From Ships

With the acceleration of economic globalization and growing prosperity of modernshipping industry,oil pollution from ships become an important source of pollution inthe marine environment.In recent years,a number of major ship oil pollution incidentshave happened,which brought calamities to human,left people deep impressions.It hasaroused great attention.China as an oil importer,oil maritime traffic,there are many oilpollution accidents,without perfect oil pollution damage compensations system as thebasis.Although China participated “Convention on Civil Liability”,China is not amember of the Fund Convention,also has not perfect ship oil pollution fundsystem,which make it difficult to find the applicable laws for many cases of oil.In thispaper,the writer will analysis the operational aspect and the problems last twoyears,which is the collection and use of the oil pollution fund,then learn the successfulexperience from other countries,present the suggestions to perfect the ship oil pollutionfund in our country.In addition to the preamble and balances,four chapters altogether.Chapter I will overview the oil pollution damage compensation fund system fromships.A general introduction about the system of the international oil pollution from shipsconvention and the responsibility mechanism,then analysis of the legal basis for the shipoil pollution fund,last overview the properties of the ship oil pollutionfund.ChapterⅡ will discuss the current situation and problems of oil pollutioncompensation fund in our country.A overview of the background of how to levy andmanage the oil pollution compensation fund,then analysis the operational aspect last twoyears,which is the collection and use of the oil pollution fund,discuss the problems of theoil pollution fund in our country,including the theoretical and practicalproblems.ChapterⅢ introduces the international experience of the ship oil pollutionfund.It proceeds to evaluate successful experience for the internal legislation andconcerned aspect from the United States,Britain,Canada,learns from the developedcountries according to the situation of our country.
