Legal Problem Research Of Patent Pool Basing On Technical Standard Anti-monopoly

With Technical Standard and patent increasingly combining,patent pool basing on Technical Standard gradually becomes the important main body of patent licensing; undoubtedly it has the nature monopoly characters.It has showed misusing the market domination and holdbacks the technical innovation.Recently,it has many literatures of Technical Standard and patent pool anti-monopoly research.But the research about special monopoly of their combination is little.The dissertation simply studies on special features of the patent pool basing on Technical Standard.The following are the main achievements of this dissertation:The first,the text introduces the Technical Standard and patent pool definition.Setting forth the reasons for combination of Technical Standard and patent pool and taking a conclusion is inevitable for the both integration body by summarizing the patent licensing issues of Technical Standard spreading and I indicate view on this.The second,the paper puts emphasis on the patent pool basing on Technical Standard anti-monopoly through analyzing through Patent Pool basing on the Technical Standard anti-monopoly in self literature and Patent Pool basing on the Technical Standard patent licensing agreement anti-monopoly.The third,I research the Patent Pool basing on Technical Standard anti-monopoly legislation practice in American,Europe and our country,and I show my opinions on these.The last,on the basis of above,I conclude the relations of the Patent Pool basing on Technical Standard and monopoly.I give some advice about our country anti-monopoly law and practical economics of our country.Moreover,I put my opinion for our country anti-monopoly system,which is setting up "Chinese enterprise association" to regulate patent misusing.
