Patent Pools Involving Technical Standards Monopoly Law Regulation

In the modern high tech industry domain, the developed countries generally use the standard-patent pattern to joint the market competition. Based on the purpose of obtaining the advantageous market point,it is an important method to repel competitors which takes the patent technology as the backing.Foreign enterprises which monopoly high tech product core technology and the production technical standard make correlation enterprises of our country difficult to develop.Starting from the realistic questions, the article combs the questions and proposes the solution. It uses the semantic analysis, the real diagnosis analysis and the comparative analysis to explain the questions and give the answer.The first chapter involves the theory of law analysis of technical standard and patent pool. The second chapter involves the problems of the counter- monopoly of the technical standard the patent pool in our country.The third chapter involves legislation comparison research of counter-monopoly of standard patent pool in overseas. The fourth chapter puts up the correlation suggestion for the counter-monopoly of standard patent pool to our country. In order to defend the developed country of continue using the patent pool to monopoly the market in our country, the article gives a preliminary design of counter-monopoly system about the patent pool jointed with technical standard on the basis of learning the experiences of other countries and analyzing the reality of our country.
