Right to Pre-emption,or the priority to buy,means that certain person takes precedence,by law or an agreement in accordance with the law,to buy the subject matter under the same conditions over a third person when owner of the subject matter decides to sell.Right to Pre-emption applies not only to the relationship between rental housing but also to other legal relations,with typical significance on the relationship between rental housing.However,China's current legal system for housing pre-emption provisions are rough and simple,and some are even unreasonable,which leads to many difficulties in the application of judicial practice.This article focuses on the most controversial issues and come up with personal arguments,thus forming a comprehensive and systematic system of housing tenant pre-emption.The author makes a through study on academic perspectives and current status of legislation and practice about China's Housing Tenant Pre-emption,based on which,rather detailed and rigorous contemplation and analysis are made in this article,and then legislative suggestion on reforming and perfecting China's Housing Tenant Pre-emption System.
