The right of preemption of lessee, the preemptive right of the lessee. It broke the Civil Equality the principle of empowerment, as a kind of civil privilege. In recent years, with China's reform of the housing system and two levels of housing market opening, the sale of housing is increasingly widespread, the preemptive right of the lessee the problems caused by the increasingly prominent, resulting in a large number of disputes. Because the current law of our country house purchasing priority rules are too general, so this paper details from the start, a detailed analysis of the house purchasing priority system. In this paper, except the introduction and conclusion, is divided into four parts:The first part is the preemptive right of the lessee system theory, mainly discusses the concept of the system, as well as the characteristics of value, reveal the establishment of preemptive right of the lessee for the stability of the whole social system which has an important role.The second part is the establishment of Housing Lessee preemption system necessity. This part from the academic circles and the practice on the abolishment of the dispute obtains, itemizing the establishment of China's Housing Lessee preemption system is very necessary, for the stability of our present social situation is also very important.The third part is the preemptive right of the lessee exercise. On the lessee priority when established, how to exercise and so on are discussed, in order to help make better use of the right of judicial practitioners.Finally, it is Housing Lessee preemption system conflict processing mechanism. On the preemptive right of the lessee and other types of purchasing priority coexist, how to solve the problem of conflict, gives his own insights and views.
