On the whole,both civil joint tort and criminal joint infringement are the special forms of infringements.The indefinite boundary between them causes the inconvenience for the judicial application owing to the vagueness of legal provision,complexity of the conclusion,different understanding of each people and the theoretical conflicts in each field.This thesis aims at analyzing the legislative purposes,the essences,the constituent elements and the legal liability of civil joint tort and criminal joint infringement theoretically,so that we can definite them correctly in practice and avoid mixing them two or destroying the order of laws.In addition,we can also expect the balance of interests between victims and perpetrators and the real justice.
