Three rural issues have always been bottleneck which concerns the overall development of our country.To solve this problem as well as narrow gap between urban and rural areas and improve the farmers' living standard,the government has done much more to speed up the development of agriculture and still more priorities have been given to farmers to inspire their positivity.However,as a Chinese ancient saying goes,"If you give someone fish,you feed him for a day.But if you teach him how to fish,you feed him for a lifetime."It's better to render farmers just property rights than satisfy some of their material needs.With the backdrop of land rights situation in our country,only the possession of land rights can be an opportunity for farmers to change their destiny.The progress of gaining or absence of farmer' property right in land shows the special relationship between farmer' property right in land and the formalization-of law,witch relate with special power construction and its running,with the absent of formalization of law.This thesis,as far as the relationship between land rights and the justness of law is concerned,argues that the economic root of three rural issues lies in the poverty of farmers' land rights,which in turn lies in the fault of the law that is deficient in guarantee the farmers' land rights.The situation,that is a lack of necessary rational rules in land laws in this modernization jural society,in particular,coupled with a shocking absence of jural procedure to prevent the arbitrary violation from authorities to lawful rights,will have to pay for the debts.This thesis holds the view that it's essential and necessary to establish a jural system in accord with the modern law forms,in which law will be nothing but to protect the legitimate rights and farmers' property rights.Only that can be a permanent cure for the three rural issues.
