Research On Bankruptcy System Of Natual Person

The bankruptcy system of natural person is the most important part of bankruptcy system. China has set up its legislation after 12 years' research.The author does a thorough study of the basic theory of the bankruptcy system of natural person in this thesis. And the feasibility of setting up the system in China is also discussed in the thesis.The thesis is divided into three parts and composed by seven chapters.The first part is the review of Chinese bankruptcy system.This part discusses the current situation of China and emphasizes that it is very necessary to set up the system in China as soon as possible.The second part of the thesis pays attention to the basic theory of the bankruptcy system of natural person.The connotation of bankruptcy of natural person is discussed at the beginning.Then the bankruptcy capacity is discusssed. The legal characters of bankruptcy system of natural person is concluded at the end of this part.At the third part, the author recalls the whole history of bankruptcy system of natural person.The differences of the system in UK and US is discussed also as that in Germany and France.The trend of legislation in this field is discussed also. The thesis makes several suggestions to China after study the challenge of what the system is facing.The fouth part focuses on the feasibility of setting up the bankruptcy system of natural person in China.The thesis comes to the conclusion that it is very necessary to set up the bankruptcy system of natural person in China as soon as possible after makes thorough discuss in four fields including the function, the legal system, the philosophy of the law and the need of market economy.The fifth part is the last but not the least part of the thesis.This part discusses three questions including the legal mode,the concrete assumption of the legislation and the perfection of Chinese current legislations.At the conclusion part of the thesis, the author appeales again that China should set up the bankruptcy system of natural person according to Chinese own situation.
