On The Establishment Of The Insolvency Regimes Of Natural Persons

This thesis is described from four respects around natural person's bankruptcy legal system: First, overview of natural person's bankruptcy legal system , explain concept,characteristic , evolution , function or value of natural person's bankruptcy , various countries' legislative example and legislative overview of our country mainly.Second, the necessity of natural person's bankrupt system that our country sets up: It is a need of economic development of market of our country; It is a need of maintaining the market economy order; Improve the need of the legal system of market economy of our country; It is a need which meets the economic globalization and accession to the WTO. Third, the main obstacle and countermeasure of natural person's bankrupt system our country sets up. The main obstacle shows: The economic base to set up natural person's bankrupt system is deficient; influence of traditional culture.; the related legal system is not improved; worry of consequence that natural person's bankrupt might cause ,etc. The countermeasure include: Dispel the misunderstanding to natural person's bankrupt system, See clearly of our country mainstream of economic development that set up terms and establish the foundation for natural person's bankrupt system; Take measures actively to accelerate legislating, and strengthen the related institutional improvement.Fourth, the concrete design of the bankrupt system of natural person of our country, Including legislative mode , bankrupt terms of applying for;the bankruptcy discharge system; exempt property system; summary procedure,etc.
