A national symbol of social civilization is the women's rights, and the women's labor rights is the very important right of the human rights. Because labour is not only the means of living, but also the development of individual creativity and personal dignity, etc. As it becomes Constitutional rights, human rights issues in our country was unprecedented concerned. Protect women's right of equality employment is an important content of the protection of human rights. However, with the labor market situation is becoming more serious,women workers discrimination problem in employment especially prominent. Although our government has issued a series of laws and regulations to protect women's right of equality employment, but the employment market is still cannot reach the legislation effect in reality.The purpose of this thesis is to provide a useful way to establish security system of women's right,with right of equality employment as the theory fulcrum, through the employment status and typical discrimination analysis, from learning international conventions, America and Hong Kong in this experience to find the solution.The article has divided into five parts:34,000 words.The first part, the employment protection of female laborer theory and its significance, for the purpose to protect women's rights of equality employment. First, from the development of equlity employment,then analyses the connotation of the equality employment and the significance of Anti-employment discrimination in employment, autonomy and equal right to employment relationship, and social responsibility of the enterprise should ensure laborer have equal right to employment.The second part, the international convention,United States, Hong Kong Anti-discrimination employment system'enlightenment. Through the introduction of the international conventions, the developed countries and Hong Kong female employment law system,provides beneficial reference for the protection of female employment rights legal system.The third part, China anti-employment discrimination laws and defects. Analysis on the existing labor protection of female employment rights legislation and anti-employment discrimination. Our country's existing anti-employment discrimination laws scoping not clear, relevant provisions problems such as lack of maneuverability need to make detailed and clear.The fourth part, China's employment status and causes. To analysis present market in women's employment of inequality, then pointed out the reasons of employment discrimination are social culture, economic and physical differences.The fifth part,eliminate gender discrimination employment system. Put forward viable path to solve the problems of the protection of female equal employment under the reality in China. Actively introduce gender concepts in the legislative process of gender analysis. In the constitution equal right to employment, formulate specific laws and perfect our country of birth insurance system, special protection for women's right of equality employment.
