Sino-Japanese East Sea Of China Issue And The Protection Of Maritime Rights And Interests

The issue of East Sea between China and Japan comes from the 60's of 20th century, with economic development,demands of oil and other strategic resources are growing more and more,China and Japan unavoidably have more and more frictions on this issue. Diaoyu Island became one of the main focus of the problems on the East Sea of China issue as a result of it's special geographical location.The solution of this issue is very important to promote China's economic development,safeguard national sovereignty, national security,marine rights and interests.China adheres to the basis of consultation with the demarcation principle of natural extension,and advocates the peaceful settlement of the East Sea of China with Japan,putting aside disputes and seeking common development,through diplomatic channels of Sino-Japanese East Sea of China to achieve an effective solution to the problem.This article is divided into three parts;it gives specific suggestions of how to protect the rights and interests of East Sea of China by the presentation of the origin and the essence of the Sino-Japanese East Sea of China problem.The first part introduces the origin and the development of Sino-Japanese East Sea of China issue,and analyzes the essence of the problem.It puts forward that the Diaoyu Island is the main focus of Sino-Japanese East Sea of China problem.The second part gives a detailed analysis of the divergences which are caused by the differences of the principle of delimitation of the continental shelf as well as the effectiveness of the delimitation.It also reviews the relationship between the continental shelf and exclusive economic zone under the International Law.The third discusses how to protect China's maritime rights and interests, expatiates on the effective ways of protecting maritime rights and interests through two aspects-necessity and feasibility.
