Study On The Improvement Of Wild Animals Protection Law

Nowadays, the protection of wild animals has drawn close attention from all countries, including China. In recent years, a series of problems, such as over-hunting and loss of the habitat, have posed a serious threat to the survival of wild animals, which puts them on the edge of danger. The future society, we must know clearly, based on the effective management, deep exploitation and sustainable utilization of the natural resources including wildlife resources, will be set up on the renewable energies and natural resources. Human should carefully consider and properly handle the survival crisis of wild animals from the aspects of legislation and rationality.It's an urgent affair how to let people live together with wild animals harmoniously by achieving the harmony between the protection of wild animals and economic development. According to the practical experience of all countries, the laws which have the coercive power of state play an important role in the protection of wild animals. It has become an international trend to emphasize the legal means on the protection of wild animals. Many developed countries have enacted a series of complete rules and regulations for the protection of wild animals. Since the founding of New China, we have made great progress on the legislation of wild animals' protection. However, with the social development, some problems have arisen: serious protection situation, more and more endangered wild animals. The limitation of our nation's current laws on the protection of wild animals has become more and more obvious, which could be deal with by improving the wildlife protection law.Based on the above background, this paper firstly discusses the status of wild animals' protection in our country, and briefly introduces the legislation of foreign countries and international conventions, then it specifies the significance and necessity to improving the protection law of wild animals in detail. Secondly, according to our country' practice on wild animals' protection, this paper analyzes many problems existed in the wildlife protection law, such as the lack of the legislation purpose, the narrow range of the protection of wild animals, the unscientific definition of wild animal, the imperfect system and the separation with the criminal law. Thirdly, learning from the typical nations' legislation on wild animals, we can gain the helpful experience to improve our wild animals protection law. Last but most important, this paper presents some principles the law should stick to. The author also puts forward corresponding measures according to the current problems in wild animals protection law, and suggests that the structure of the law should be improved in order to protect the wild animals, and the items about animal welfare should be added, all which aim at helping to improve our nation's wild animals protection law, and promoting the development of the project of wild animals' protection in our country.
