Comparative Research On Government Procurement Legal System Between China And America

As a kind of system, the government procurement had been established among the states of capitalism in the years between the end of the 18th century and the beginning of the 19th century. As one of the most important management tool of every government in their economic life, the government procurement system is playing a more and more important role in the process of trading both in and abroad.Through comparative research on the main contents of the government procurement legal system between China and America, this article is aimed at giving some useful advices to develop and improve the government procurement legal system in China. And this article is also intended to make up the shortness of the existing government procurement legal system in China.The first part of this article is about some basic things of government procurement, including its conception, characters, objects, procedure, main content, basic principles , and is aimed at giving a briefly introduction of what is government procurement and the system of the government procurement. And the second part of this article is about the origin and development of government procurement both in China and in America. The America is one of the countries who brought in the government procurement system earliest, and it is also one of the countries who have the most developed government procurement system in the world. While in China, the modern government procurement system had been started relative late compare to the more developed countries. Although it had being improved a lot then on, still we were left behind the more developed western countries. Also in this part, I briefly introduced the content of government procurement legal system both in the two countries. After the introduction, you can know the framework and the basic content of the legal systems both in China and in America on this subject.The third part does matter in this article. I did a comparison research between China and America, about the differences of the government procurement legal system in the following aspects: the measures taken in the process of the government procurement, the government procurement contract, the protection of local productions, the supervision system and the compensation system of the government procurement. And in the last part of my article, I did some research in the shortness of our government procurement legal system. At the meanwhile, by study from the America, I gave some advices on how to improve certain aspects of the government procurement legal system in China, in the respect to solve the problems existing in it.
