As an institutional innovation of public consumption, government procurement has become the most important instrument for expenditure management of public fund. During the last century, government procurement as a system has been fully developed and accordingly an appropriate legal system has been established in some countries. With unceasing promotion of economic globalization, government procurement has been playing a significant role in the world trade. To regulate the global market of government procurement, several international organizations has enacted some legal documents in this regard, among which WTO's Agreement on Government Procurement (hereafter referred to as GPA) is an influential one. GPA setting up a disciplinary and legally binding system pursues openness, competition and transparency in the government procurement area to enhance liberty of world trade. China practiced government procurement later than most of the countries, and the execution of Law of Government Procurement of People's Republic of China on January 1st 2003 launched establishment of a legal system about government procurement in China.Although GPA is not binding upon China at present, with further amalgamation of China's economy into WTO, gradual opening of China's government procurement market and internalization of its activity will prevail in the coming economic reforms. Therefore, to perfect the concerning legal system by following international practices and taking GPA for reference is impendent for China to play a more prominent part in global government procurement.This article divided into 5 parts has made detailed analysis and comparison between GPA and China's Law of Government Procurement.
