The Balanced Adjustment System Of Morality And Law In Chinese Marriage Relationships

As the main methods for adjustment of human society relationships,Ethics and Laws are attached to each other by special relationships,which reflect the difference and commonness between Ethics and Laws.Based on the generally analysis on the special relationships between Ethics and Laws,this dissertation bring up with a concept of"The balanced adjustment system between Ethics and Laws".I picked up Marriage relationships and Marriage Law as the sample to research on the essential construction and meaning of this concept.As the basic relationship of human being,Marriage forms the fundamental of the society.The ethics of Marriage is an irreplaceable part of social ethics.The marriage law includes all the principles and regulations of the marriage and family relationships.Due to the unique feature of the marriage law's object,it has been heavily related to the ethic elements.Therefore,to pick up the marriage and marriage law as the sample will obviously disclose the features of this special relationship between Ethics and Laws.In the first part of the dissertation,I compared the Ethics and Law on the theoretical side and included the special relationships between Ethics and Law as "The balanced adjustment system between Ethics and Laws".In the second part,based on this system,I conducted a thorough examination of the marriage and marriage law from the ethic perspective by analyzing the relationship of ethics and law,as well as the marriage law features in various historical period and different culture surroundings.In the third part,I focus on the adjustment of Chinese Marriage Law in year 2001,making a deep exploring in the function of the system used in the adjustment.The purpose is to find out the best way in executing and improving of the marriage law.In this way we can provide a theoretical foundation on which China can scientifically construct its marriage law and promote the building of harmonious families.
