Mental health problem is a more prominent social issue, especially the harmful acts to society of the mental patient. In our country, the treatment to the psychotic offender is still the traditional penalsanction complanation. The direct purpose of Criminal Policy is to treat offender in humane way. Criminal Policy provides a new platform for us to study the psychotic offender treatment system. In this paper, the research on the psychotic offender treatment system in a view of ought-to be criminal policy.The first part expound the basic concept of Criminal Policy, and give the concept of the ought-to-be criminal policy, and set a starting point of this paper. The understanding of the phenomenon of crime in Criminology is the Criminal Policy's basic concept. Towards the happened offence in Criminology, Criminal Policy investigate the treatment to the offence. Criminal policy is the passive and humane treatment to the all acts that harms the society, which is organized by state and society. Ought-to-be criminal policy is the criminal policy that should be so, is a research view of Criminal Policy. However, ought-to-be criminal policy should be based on the principle that humanism, legalization and scientific.The second part defines the area of psychotic offender in Criminal Policy. The offence of criminal policy is all acts that harm society. In Criminal Policy, psychotic offender is the person with the mental illness that already or maybe affect the ability to identify and control, who harms the society.The third part construct a systematic treatment system against psychotic offenders, through improving the relevant clause of"Criminal Law"and making"Mental Health Act". Use methods of Criminal Law, administrate, civil, economic and society to treat psychotic offenders in humane way, So that they revert to the community.In conclusion, based on the existing treatment system against psychotic offenders, absorbing all the scientific means in nowadays society, this paper construct a well arranged treatment system against psychotic offenders in Criminal Policy view, through expounding the basic concept of Criminal Policy. The author expects that the paper would be beneficial to the practice of the treatment against psychotic offenders.
