Studies On The Subjects Of U.S. Plea Bargaining

The dissertation mainly discusses the subjects of "Plea Bargaining": the prosecutor , lawyer , judge, defendant and the victim. From the style of writing , the dissertation is composed of four sections: part one is the brief account of the "Plea Bargaining" . part two is the behavior of the subjects of Plea Bargaining. Part three is the role of the subjects "Plea Bargaining" and the social interaction between the subjects. Part four is analysis. If we try to construct the plea bargaining system in China, What are the obstacle factor of the subject.In the writing , the dissertation adopt the methods of literature researching , description researching , qualitative analysis , interdiscipline researching and comparative studies. At first , form investigating the literature , we can have a general idea about the origin, the main content and the development of plea bargaining in American. Then , from using the method of description researching and qualitative analysis , we can know the character of the behavior of the subjects of Plea Bargaining. In the part three , I adopt the theories of social role and social interaction of sociology to interpret the action or reaction on each other between the subjects of plea bargaining . At the end , the comparative studies of subjects of plea bargaining between American and china.Researchers in china introduce generally the plea bargaining system at first, and then launch the theoretical discussion on "transplanting" or "non-transplanting" of the plea bargaining system to china. There are a lot of researches about plea bargaining in china but is not sight from the subjects of plea bargaining .The dissertation studies the behaviors of subjects of plea bargaining systemtically that make the plea bargaining becoming a lively social action from a bald system .The dissertation will bring us a new sight that we can solve some questions that have answer now.
