Plea bargaining system is an important criminal procedure system of American, the system originating in America receives various countries approval gradually, and becomes the judicial practice in the word scope. The reason that plea bargaining to be the swift and violent development in the world scope, obviously has certain rationality. The purpose of this article is to introduce the plea bargaining system of America, Germany, Italy and so on, analyze its rational factor, prove to unify our county national condition, reasonably model and transplant the content of plea bargaining , establish the charge and defense consultation system that suits Chinese national condition.The thesis is divided into four parts. The first chapter makes an introduction on plea bargaining system and it's development. The second chapter, through to analyze the just value, the efficiency value, prove the rational basis of plea bargaining .The third chapter, embarks from our country's reality, analyzes the necessity of plea bargaining, discusses the feasibility of our country to transplant plea bargaining and analyzes some questions on the feasibility of system from idea foundation, system foundation, practice foundation. The fourth chapter, in the analysis foundation, propose to transplant plea bargaining system, found the related principle of Chinese charge and defense consultation and its concrete programming.China's development needs a perfect legal system environment, but the perfect legal system environment must summarize in our county legal system success experience, absorb and model the world advanced law culture achievement, consummate our country legal system unceasingly.
