| Land confiscation and home demolition is an inevitable and necessary phase in the urbanization of our country. Because of the large population involved in it and a series of problems triggered off by it, it has been regarded as one of the most serious threat to the stability of the whole society. Based on the information collected through on-the-spot observation, interviews, and literature review, this thesis describes the condition of human rights protection in the two demolished villages, situated in the suburbs of Shiyan city. Focused on the farmers, who lose their house as well as their land, this thesis makes a systematic, comprehensive, and profound analysis of the reasons for the inadequacies existing in the right protections of those households relocated due to building demolition. This analysis also draws upon modern land confiscation system in order to explore the factors leading to the depravation of the rights of the households relocated due to building demolition. The whole thesis can be divided into five parts.The first part serves as an introduction, covering the background and the significance of this research, the recent research accomplishment in this field both at home and abroad, research methodology, the background information of the survey area and the definitions of several terminologies.The second part analyzes the law policy of our country concerned with land confiscation and home demolition, and describes the human rights enjoyed by the households relocated due to building demolition. According to this thesis, these rights include: property ownership rights, dwelling rights, land using rights, rights to know and rights to appeal.The third part discusses the transformation of the production mode and living style of the villagers caused by the land confiscation.The fourth part specifies the problems that exist in the right protections of the households relocated due to building demolition and tries to reveal the deep causes for these problems.The fifth part serves as a conclusion part. It reaches a conclusion that the inadequacies existing in the right protections of the households relocated due to building demolition are the result of an interest game. The deficiencies of this thesis are also pointed in this part. |
