Research On The Civil Evidence Collection System

In civil action, there are two questions front the judges,questions of fact and questions of law . Questions of fact are in fact questions of evidence, including questions relating to the investigation and collection of evidence, evaluation of evidence and allocation of burden of Proof. Therefore, we must always take into consideration the actual conditions of China when we are studying the admissibility of evidence system so that we can formulate an admissibility of evidence system, which is the best suited to China, in the light of China's present law of evidence as well as the actual conditions of China, this dissertation will make a systematic and theoretic study of the admissibility of specific evidence and related problems with a view to laying a positive role in improving China's system of evidence and in bringing to light the sptrit of the system of evidence.
