Probing Into Mass Torts Damages

With the development of the industrializition,large-scale production are increased gradually,and then mass torts will increase rapidly. While people were still having a lingering fear about those incidents such as "the big head baby" inferior milk powder incident (2004), "SuDan" incident (2005) and the "red-yolk duck eggs" incident (2006) , "SanLu" milk powder (2008) scandal shocked the whole nation again and led to even more adverse impact. Because of the frequent disputes of mass torts, scholars start to pay extensive attention to mass torts and its damages ;and they focus on such question that how to relieve the victim mass. In this paper we proceed from some typical cases of mass torts, and then analyze its concept, behavioral characteristics, the social background of its emerge and its existing state at theoretical level. Moreover, this paper demonstrates where the complexity and the plight of large-scale infringement damages lie under current situation. This is, how to relieve the victims so that they receive due compensation without impeding social progress and development. Then through an analysis of the socialization of mass torts and the relief patterns in various countries, the author manifests that establishing appropriate funds and liability insurance are applicable ways to deal with emerging mass torts and protect civil claim rights of the victims...
