Administrative Agreement: Research On The Contractual Governance Pattern Of Regional Cooperation

According to the outside and interior background of regional economic unity, cooperation of local government, and legal system gradually perfected, accompany with administrative agreements appeared, and have became one of the most significant cooperative system aiming at realizing cooperation and solving disputes. However, the research field is not familiar with this phenomenon. Hence, there exists so many problems for constructing this kind of system such as we don't quite understand the definition of administrative contract, the contents and form are not understandable, the effective of it etc. The majority of researcher utilized different angles of economics management public administration etc. Hardly have the researcher study from administrative law. This paper introduce actual and residential methods to study the cooperation between the areas Yangzi Delta and Zhujiang Delta, and introduce comparative method to analysis and input codes and regulations American Interstates Contract and Administrative Agreement. At last, put out useful suggestions for the development and practice of administrative agreement legal system.The first part of paper is the basic theories. In this section, definition, effective and type of administrative have been described clearly.The second part of paper is the practice under the background of regional cooperation. This section consists of the reason of Administrative, the development, contents, process for dealing with administrative contract in the areas of Zhujiang Delta, Yangzi delta, concluding the basic frame of Chinese administrative contract, and the subjects and main clauses etc.The third part of paper analysis the legal basement of related American administrative contract legal system and the main structure and mode of acting, all of these could as reference for our country.The last part of paper proposed the suggestion of administrative agreement legal system, focusing on the practice and the unsolved problem, and also put out advises from various angles of contents of administrative agreement, enforcement body, disputes solving mechanism, and platform of system.
