On The Installation Of Administrative Review Special Organizations In China

This paper starts from the current situation of the installation of administrative review organizations in China, and analyzes the deficiency of these installed organizations as below: there is abuse of power in these organizations, the responsibility of administrative review organization as a main body is not specific yet, the specialization of administrative review is still weak and lack of complementary system. The reason for this deficiency is the lack of independence in administrative review organizations. To reinforce the independency of administrative review organizations, it is necessary to set up special organizations of administrative review for the justice and uniform responsibility in organizations for administrative review, as well as the specialty and systematization of administrative review.After comparing and analyzing the installation of administrative organizations at home and aboard, the author firstly suggests that the installation model of administrative review organizations in South Korea should be used as a reference for China and states why. Finally on referring to the system of administrative justice committee in South Korea and in line with the situation in China, the author puts forward the suggestion of setting up the special administrative review agency- The Department of Administrative Review. Andthe author makes concrete analysis from the aspects of the significance of The Department of Administrative Review, and its quality, installation model, legal status, scope of power, staff make-up and rules of procedure respectively.
