As an integral part of judicature in ancient China, remission had been put in full effect and had exerted tremendous influences on politics, economy, andmilitary in the Two Hans—the Western and the Eastern Han Dynasties. Through the research of its historical origins and contributing factors, the thesis draws a conclusion that it is closely related to the contemporary prevalence of confucianist Yin-Yang thought as well as the social need. Remission did have achievements in showing royal benevolence and appeasing the people, and even rectifying unjust cases and stabilizing the society. Whereas it has been denied by scholars on account of its usurping authority and implementing arbirearily. The judicializa-rion of remission remains prior tolegislature, and the thesis points out that only if remission is regulated into judicial system could it be given full play in administration, with references of its categories, charact-erisrics, and determiniations in the Two Hans.
