Study On The Well-known Trademarks Anti-dilution Protection

With the development of international trade, Well-known Trademark protection has become one of the hot issues. The full text ,using the theoretical and empirical analysis of the combination Method,try to build and improve a prefect the well-known trademark Anti-dilution protection system.This article is divided into three chapters. The first chapter describes the well-known trademarks Anti-dilution theory.If someone use the well-known trade mark identical or similar mark on different or not similar goods and services,it may constitute a well-known trademarks dilution. Obviously, the traditional confusion theory can not effectively carry out well-known trademark protection,so we need to introduce subjective association theory to overcome the limitations of the confusion theory.The second chapter is about the practice of the well-known trademarks Anti-dilution theory. The International Convention for the protection of well-known trademarks and The the well-known trademarks Anti-dilution protection regurlation of Germany, France, in particular the United States can improve china's well-known trademarks Anti-dilution protection,and give a great reference. China's well-known trademark Anti-dilution protection still exsit a great lack,although having achieved great success in practice.The third chapter proposed the idea of improving the well-known trademark Anti-dilution protection. In the pursuit of "rights and interests" in the value of equity,the author will discuss the existing problems between the well-known trademark Anti-dilution protection and cross-category protection and unfair competition.
