Consideration About Administration Of Jus Cogens Legislation

Administrative Enforcement is frequently used means of implementation in China's administrative practice, and an effective way to realize the executive administration and administrative purposes. At the same time, the administrative enforcement action easily infringes personal rights, property rights and other fundamental rights of citizens, legal persons or other organizations. Sometimes these rights are adversely affected and can not be restored . These impacts on the social life is of great significance. Having based on it, countries have already tried to enact legislation to regulate its system of administrative enforcement actions.This article has six components: Preface; the first chapter, the basic concept of compulsory administration; the second chapter, the law understanding of enforcement administration; Chapter III, system architecture of China's Administration of Jus Cogens; the fourth chapter,the author's considerations and recommendations of Administration of Jus Cogens (Draft). The main purpose of this article is that through my in-depth analysis on China's administrative enforcement system I put forward my own proposals on China's Administration of Jus Cogens.Looking at the ideas in this article, first, the author analyses the basic concepts of compulsory administration ,and analyses the value of the Legislative Administration mandatory orientation. Second, the author investigates the existence of China's administrative enforcement system and puts forward the measures of the problem. The last, the author analyses these main theoretical differences considers them and puts forward my own legislative proposals. Innovation of this article is that using the basic principles of the Constitution Law, the Administrative Law, the Legislative Law of administration ,the auther deeply considers the disputes of China's Administration of Jus Cogens (draft) and tries to put forward my own legislative proposals.Given the limited capacity of individuals, the work which I have done can only be regarded as the attempt to explore compulsory theory of administrative practice and legislation.
